First, I don't think anyone can go wrong with this Lego Set However check out Blongo We scooped up this game a few weeks ago for my girlfriends niece, who is 9, and this was by far her favorite present. It will be an especially big hit if the you/they are having a party for him.
Don't know how gadget-oriented he is, but you might look at Radio Shack or a similar electronics store for a crystal radio. It's something he can make with his cool uncle. Doesn't require electricity. And he can stay up late at night listening to AM talk radio.
If he does happen to like Legos this book about forbidden stuff you can make with Legos will be a big hit.
So, no legos or videogames. You're not making this easy. I remember when I was a kid, one of the fist letters I wrote to Santa was for a cool watch. I did not know what kind I wanted, just a cool one. If not that, then I would recommend an xmods radio controlled car. They can be had for under $50 at radio shack. The best part about them for a busy fingered kid is that they are highly customizable. Don't like the wheels, replace them. Ride height too low for carpet, raise it. Add lighting kits, new motor, chassis upgrades, practically every piece can be swapped out or customized. It can be addicting, even for an adult, believe me.
